Trial For Man Accused Of Mingo County Murder Postponed
A pre-trial hearing was scheduled Thursday morning in Mingo County Circuit Court for Brandon Fitzpatrick, the co-defendant in the murder of former coal executive Ben Hatfield.
However, due to additional counsel being brought in on the case, the trial has been pushed back until August 10.
Fitzpatrick was represented by Williamson attorney Jerry Lyall, who was counsel on behalf of the public defender’s office. Lyall requested Susan Van Zant as co-counsel in the case.
Van Zant requested a continuance in the case, due to lack of familiarity with the case. Van Zant asked for three months to prepare.
Judge Miki Thompson granted the request.
Fitzpatrick is a co-defendant with Anthony Arriaga of Gibsonburg, Ohio. Arriaga pleaded guilty to first-degree murder and robbery charges connected to the death of Ben Hatfield. Arriaga faces life in prison on the murder charge and 40 years for a robbery charge. He will be sentenced May 17.
